a group of all dressed in brown, the surrounded the statute base and would not let anyone near. Drew swords on people.

You leave and get a room for the night.
later around 11 pm things have quieted down in the city. As you head back out towards the statue you do see guards are still stationed even at night.

its across a bay, you can see shapes but they are to far away to make out any kind of detail

Sarin will wait until they are past the guards and say in lower tones "We would be better off coming under cover of darkness rather than trying something now we are more at risk of being seen now."

Phil suspects that a shift change has recently happened and these guards will be on duty until morning. He'll go with the suggestions of those more used to stealth, however.

Hildr will scan the area with the Eye of Odin (automatically sees through illusions). Then once Felix casts his Sleep spell she will move forward and use Hold Person on any guards that the Sleep spell fails to bring down.

Sarin will give Felix the time to cast his spell before attempting to sneak over by the guards.
